Property Access

Safety is the first and foremost priority of Carload Express. The right of way and property of our railroads is private property. Persons found on railroad property without expressed written permission are considered trespassing and may be arrested and prosecuted.

Temporary Entry Permit [Adobe pdf]

Any entry or construction activity on railroad right of way must be authorized by the railroad in writing via a Temporary Entry Permit (“TEP”). 

The applicant must submit the completed application to the Right-of-Way Manager along with a check or money order, made payable to the specific Carload Express railroad that the applicant is working on, for the non-refundable $1250 application fee. The application must include the exact location and scope of work. To aid in locating the specific site area, Railroad Valuation Maps may be available. Incomplete applications will be rejected.

Insurance Requirements [Adobe pdf]

Generally, applicants must provide a Certificate of Insurance showing Carload Express, and the corresponding railroad (above), as the certificate holder.  This certificate must not exclude railroad work or operations.

On-Track Safety Request [Adobe pdf]

Projects that will block or foul track will require On-Track Safety Protection. Carload Express reserves the right to require On-Track Safety Protection for any project.  The applicant must submit the completed application to the Right-of-Way Manager along with a check or money order, made payable to the specific Carload Express railroad that the applicant is working on.

Utility Occupancies

An applicant may obtain a Utility Occupancy License (Wire or Pipeline) through a formal application process. To initiate the process the applicant must fully complete the application form provided in the link below. Incomplete applications which do not include all necessary information will be rejected immediately. The completed application, a non-refundable  Application Fee and a non-refundable Engineering Review Fee via check or money order made payable to the specific Carload Express railroad (left) is required for processing. For all fees, please see the Schedule of Fees page for details.  It is recommended that a Temporary Entry Permit application be submitted concurrently with the application for Utility Occupancy License.

Upon receipt of the application and fees, the Engineering department will review the package for approval. Engineering drawings and plans must be submitted following the Carload Express standard templates. Application does not guarantee approval. If the application is approved, a Utility License Agreement will be drafted and forwarded to the applicant for signature. The partially executed agreement must be returned to the Engineering Department accompanied by a check or money order for the first year rental payment and a Document Preparation Fee. In addition, you must submit relevant proof of insurance (outlined in the agreement) prior to execution on behalf of the railroad.

If access onto railroad property is required to obtain necessary information for the application then a Temporary Entry Permit must first be obtained. A Temporary Entry Permit is a separate application and requires the submission of a non-refundable fee (due when utility application submitted).

For “standard processing” the entire process takes between 8-12 weeks. “Expedited processing” will reduce the processing time to between 4-6 weeks and incurs additional fees. If expedited processing is required then put “EXPEDITED” before Right-of-Way Manager in the address line.

Railroad Valuation Maps

In many cases, Railroad Valuation Maps are available to assist utilities, contractors, surveyors, or others requiring Right-of-Way access or information.  It will be necessary to identify the railroad (AVR, DCR, MDDE, SWP), subdivision, and approximate milepost location to obtain the desired map.  Railroad Crossing data is available on the FRA’s Rail Crossing Locator app, available for Android and iPhone/iPad or at the following link https://fragis.fra.dot.gov/GISFRASafety/

Electronic (PDF) maps can be obtained for a $100 per page fee.
